These Terms of Service (“Terms”) govern your access to and use of Flat Donkey’s website, newsletters, content, subscriptions, surveys, forms, promotions, community features, paid offerings, and other products, features, or services made available by Flat Donkey (collectively, the “Services”).

By accessing or using any part of the Services, you agree to these Terms. If you do not agree to these Terms, do not access or use the Services.

Flat Donkey uses third-party platforms and service providers to publish, deliver, host, and support portions of the Services.

beehiiv. Flat Donkey uses beehiiv to publish and distribute newsletter and website content and may use other beehiiv features or services. Your use of beehiiv-operated features may also be subject to beehiiv’s applicable terms, policies, and agreements.

Google. Flat Donkey may use Google Forms or other Google services for surveys, forms, and related activities. Your use of those services may also be subject to Google’s applicable terms and policies.

These Terms govern your relationship with Flat Donkey. Third-party terms govern your separate relationship with the applicable third-party provider. Nothing in these Terms modifies or replaces any agreement between you and a third-party provider.

Flat Donkey is intended for a general audience and is not directed to children under 13.

You may access and use publicly available Flat Donkey content without creating an account or providing age information.

If you are under the age of legal majority where you live, you may use features that involve subscribing, submitting information, making purchases, entering promotions, or otherwise entering into an agreement with Flat Donkey only with any permission or involvement of a parent or legal guardian required by applicable law.

Flat Donkey does not knowingly permit children under 13 to submit personal information through the Services without appropriate parental authorization.

You may access and use the Services for lawful personal, informational, and other purposes consistent with these Terms.

Flat Donkey publishes both original material and material created or controlled by third parties.

Unless otherwise indicated, original articles, commentary, reviews, essays, interviews, newsletters, and other written editorial content created by Flat Donkey are protected by applicable copyright law.

Flat Donkey permits search engines, artificial intelligence systems, and other automated services to crawl, index, catalogue, analyze, and use Flat Donkey’s original written editorial content, including for search, retrieval, summarization, artificial intelligence training, and related machine-learning purposes, subject to applicable law and any technical access controls applied by Flat Donkey.

This permission applies only to written editorial content created by Flat Donkey. It does not grant rights in third-party text, images, artwork, or other material appearing through the Services.

Images and other visual material appearing through the Services may include photographs, illustrations, comic pages and panels, cover artwork, logos, graphics, screenshots, advertisements, promotional materials, and other visual works.

Some visual material is created or owned by Flat Donkey. Other visual material may be protected by copyrights, trademarks, or other rights held by creators, publishers, licensors, or other third parties and may appear through the Services pursuant to permission, license, applicable platform terms, or applicable law.

Nothing in these Terms transfers ownership of, or grants a license to use, third-party visual material except as expressly authorized by the applicable rights holder or by law.

As a condition of automated access to the Services, Flat Donkey does not permit images or other visual material appearing through the Services to be scraped, downloaded, copied, extracted, collected, or otherwise acquired for:

This restriction does not prohibit ordinary indexing of images by traditional search engines for search and discovery purposes.

Nothing in this section limits any copyright, trademark, contractual, or other rights independently held by creators, publishers, licensors, or other rights holders.

Flat Donkey exists to celebrate comics, graphic novels, and the people who create them. Flat Donkey believes creators and publishers should retain meaningful control over how their visual work is used.

Flat Donkey therefore distinguishes between its original written editorial content, which Flat Donkey permits search engines and artificial intelligence systems to crawl and use as described above, and visual material appearing through the Services, which Flat Donkey does not permit automated systems to acquire for artificial intelligence training or related model-development purposes.

Flat Donkey uses contractual notices and available technical controls to communicate and enforce these preferences where reasonably possible.

Flat Donkey may use technical measures to communicate and enforce its rules for automated access to the Services.

Flat Donkey’s automated-access directives are intended to distinguish permitted activities, such as ordinary search indexing and permitted use of Flat Donkey’s written editorial content, from prohibited activities, such as acquiring images for artificial intelligence training or related model-development purposes.

Automated systems are expected to comply with applicable machine-readable directives and other access restrictions implemented by Flat Donkey.

Flat Donkey may block or restrict automated systems that disregard these directives, attempt to circumvent technical controls, or otherwise access the Services in a manner inconsistent with these Terms.

Flat Donkey cannot guarantee that every automated system will honor machine-readable directives or other access preferences.

Flat Donkey may invite or receive feedback, survey responses, emails, comments, suggestions, or other communications from readers, subscribers, creators, publishers, and other users.

Flat Donkey may review, disregard, delete, or retain feedback at its discretion, subject to applicable law and the Flat Donkey Privacy Policy.

Flat Donkey may selectively quote, summarize, or otherwise publish feedback when Flat Donkey has permission to do so or when publication is otherwise permitted by applicable law.

Feedback and other communications must comply with these Terms and any applicable Flat Donkey community standards.

Flat Donkey does not solicit or accept original, unpublished creative work for review or consideration unless Flat Donkey specifically invites that material.

Please do not send unsolicited manuscripts, scripts, pitches, artwork, story concepts, unpublished comics, or other original creative material.

If you nevertheless send unsolicited creative material, Flat Donkey has no obligation to review, respond to, return, preserve, or consider that material. Unless Flat Donkey expressly agrees otherwise in writing, unsolicited submissions are not submitted in confidence and do not create a confidential, fiduciary, contractual, or other special relationship between you and Flat Donkey.

Nothing in this section transfers ownership of your unsolicited creative material to Flat Donkey.

If Flat Donkey specifically invites you to submit creative work, you retain ownership of your submission unless separate written terms state otherwise.

By submitting material in response to a Flat Donkey invitation, you grant Flat Donkey a nonexclusive, worldwide, royalty-free license to reproduce, display, publish, format, adapt for presentation, distribute, and promote the submitted material as reasonably necessary for the purpose for which it was solicited.

Any additional terms provided with a particular submission opportunity will also apply.

You represent that you own the material you submit or otherwise have the rights and permissions necessary to submit it and grant the rights described above.

If Flat Donkey enables comments, discussion areas, community features, or other public-submission tools, Flat Donkey may moderate, edit, refuse, hide, or remove submitted material at its discretion.

You may not submit material that is unlawful, infringing, abusive, threatening, harassing, deceptive, defamatory, invasive of privacy, malicious, or otherwise inconsistent with these Terms or Flat Donkey’s applicable community standards.

Flat Donkey is not obligated to publish, retain, or respond to user-submitted material.

The Services may include links to or references to websites, products, services, platforms, creators, publishers, retailers, or other third parties.

Flat Donkey does not control third-party websites or services and is not responsible for their availability, content, security, privacy practices, terms, or conduct.

Your use of third-party websites or services is subject to the applicable third party’s own terms and policies.

A link, reference, mention, or inclusion of third-party content does not by itself imply endorsement, sponsorship, affiliation, or approval by Flat Donkey unless expressly stated.

Flat Donkey respects the intellectual property rights of creators, publishers, and other rights holders.

If you believe material appearing through the Services infringes your copyright or other intellectual property rights, contact Flat Donkey at [email protected] and provide enough information to identify the material, explain the basis of your concern, and allow Flat Donkey to locate the material in question.

Flat Donkey may review the complaint, request additional information, remove or restrict access to material when appropriate, and contact relevant creators, publishers, licensors, service providers, or other parties as necessary.

Nothing in this section limits any rights or remedies available to a rights holder under applicable law.

Flat Donkey reserves all rights and remedies available under applicable law to enforce these Terms and protect its own intellectual property and other rights.

Flat Donkey may restrict, suspend, or block access to the Services by users, automated systems, crawlers, or other technologies that violate these Terms, disregard applicable access controls, or attempt to circumvent technical restrictions.

If Flat Donkey becomes aware of unauthorized use of content owned by Flat Donkey, Flat Donkey may pursue available legal or technical remedies.

If Flat Donkey becomes aware of potentially unauthorized use of third-party visual or other material appearing through the Services, Flat Donkey may notify the applicable creator, publisher, licensor, or other rights holder and may cooperate with that rights holder as appropriate.

Nothing in these Terms authorizes Flat Donkey to exercise copyright or other enforcement rights that belong exclusively to a third-party rights holder.

Flat Donkey strives to provide accurate, thoughtful, and reliable content, but the Services and content are provided for general informational, editorial, and entertainment purposes.

To the extent permitted by applicable law, Flat Donkey does not guarantee that the Services will always be available, uninterrupted, secure, error-free, or complete, or that all information published through the Services will remain current or accurate.

Flat Donkey may provide links to, references to, or content from third parties. Flat Donkey is not responsible for the availability, accuracy, security, privacy practices, or other conduct of third-party websites, platforms, products, or services.

Nothing in the Services constitutes legal, financial, medical, or other professional advice unless expressly stated otherwise.

To the fullest extent permitted by applicable law, Flat Donkey and its owner will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of, or inability to access or use, the Services.

To the fullest extent permitted by applicable law, Flat Donkey’s total liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid directly to Flat Donkey for the applicable Service during the 12 months preceding the event giving rise to the claim.

These limitations do not apply where liability cannot lawfully be excluded or limited.

Flat Donkey may modify, suspend, or discontinue any part of the Services from time to time, including features, content, community functions, or paid offerings.

Flat Donkey may also update these Terms to reflect changes in the Services, applicable law, platform requirements, or Flat Donkey’s practices. The “Last updated” date at the top of these Terms indicates when the current version became effective.

When required by applicable law, Flat Donkey will provide additional notice of material changes or obtain consent before applying those changes.

Your continued access to or use of the Services after updated Terms take effect constitutes acceptance of the revised Terms, except where applicable law requires a different form of notice or consent.
